Rights the state must respect, enforceable in court โ the part of the Constitution an ordinary person can actually use.
They include equality before the law, freedom of speech and expression, assembly, association, movement and profession, protection against exploitation, freedom of religion, cultural and educational rights of minorities, and the right to constitutional remedies. Education was added as a fundamental right for children in 2002, and the Supreme Court has read the right to life as including dignity, livelihood, a clean environment and privacy.
Two things are commonly misunderstood. These rights are not unlimited โ reasonable restrictions are written into the text, on grounds such as public order and the sovereignty of the state. And the right to constitutional remedies, which Ambedkar called the heart and soul of the document, is what makes the others real: a right with no court to go to is a sentence in a book.
